UN Universal Declaration of Human Rights regulates and establishes fundamental rights for all human beings, regardless of country, sex, religion or political group to which they belong. Freedom of the press, sexual freedom, freedom of expression, freedom from slavery, the right to security or freedom of defence are some of the articles that this declaration establishes.
The right to be forgotten is the right that everyone has to have their data published on the internet, whether it is true or not, erased. Many people see their data included in public lists of defaulters, or simply associated with a series of words that are detrimental to them.
What are the most common cases of data deletion requests?
- When the name appears in official bulletins associated with a complaint, seizure or debt with the administration. This is the most common case. When you have a traffic report and they have not been able to locate you to notify it, it is published in the BOE or in the BORM of each community, so that every time you look for the name or the dni of this person, everyone can know that he/she has been denounced. In addition the most common thing is that all these seizures and complaints have been updated, so it makes no sense that they continue to appear in searches, and yet they appear.
- Data published in newspaper archives. The digitization of newspaper libraries has been a problem for many users who once appeared in that newspaper. Google detects the searched name, but there may be a news of embargo or crimes such as murder, rape, etc. next to it. In this way when you search for the name of this person is associated (and in the first places) with the most prominent news of that page.
- Fake blog comments. This is also a widespread problem. We discussed it in the article: The blackmail of negative comments. These are often used by unscrupulous people to blackmail merchants and people who sell services. It is very easy that a blog with negative comments of a certain company is positioned in the top positions of google or other search engines so that when you search for the name of the company the search engine itself already advises you in the searches you select (company name + scam or deception or other barbarities that are put on the blog). Although this is reportable and can be removed, google does not desindexa it from your search engine so easily making that company lose a very high percentage of its customers.
The right to be forgotten or right to erasure should be as a fundamental right in the declaration of human rights.
And is that certain data or not certain can become a very serious problem for the day to day life of a person. Imagine an unemployed person who is looking for work and you put his name in the search engine and it appears a news that he was convicted of drug trafficking, because that person will not be able to find work in life, which already becomes a health problem.
